Illegal Immigrant Rape Suspect Released Despite ICE Detainer, Re-Arrested

The Dorchester District Court in Boston faced criticism for releasing the suspect, who is now in ICE custody awaiting an immigration hearing.

A Haitian man, who entered the U.S. illegally in December 2022, was arrested in Boston on suspicion of rape and indecent assault on a developmentally disabled person.
Despite an immigration detainer lodged by ICE's Enforcement and Removal Operations (ERO) Boston, the Dorchester District Court released the suspect in November 2023 with an ankle monitor.
The suspect was re-arrested by ERO Boston officers on January 9, 2024, and remains in ICE custody awaiting an appearance before an immigration judge.
ERO Boston plans to petition for the suspect's removal from the U.S. after his criminal case has been fully adjudicated.
ERO Boston Field Office Director Todd M. Lyons criticized the Dorchester court for ignoring the immigration detainer and releasing a potentially violent criminal back into the community.
