Overview

• Federal officials lodged the detainer after the fatal Sept. 13 incident in Elmhurst and publicly pressed New York authorities to notify or transfer the suspect to ICE.
• Edwin Cruz Gomez, 38, was arrested and charged with murder, attempted murder, assault, vehicular manslaughter and DWI; he was arraigned Sunday and remains in custody.
• Prosecutors say he offered the teen and her mother money for sex, a fight followed, and he then drove a Chevrolet Suburban onto the sidewalk, killing 16-year-old Jhoanny Alvarez and injuring her mother and stepfather.
• Officials say his blood-alcohol content was nearly twice the legal limit at the time of the crash.
• ICE says he is a Honduran national previously ordered removed in 2005 with illegal reentries and prior arrests, as Acting ICE Director Todd Lyons criticized sanctuary policies and called for custody transfer.
