Home Office Asks Appeal Court to Block High Court Challenge to Palestine Action Ban

The government tells judges the case should go through the Proscribed Organisations Appeal Commission rather than judicial review.

Overview

  • Appeal is being heard at the Royal Courts of Justice before Lady Chief Justice Baroness Carr, Lord Justice Lewis and Lord Justice Edis.
  • Government lawyers argue there is a bespoke statutory route via the Home Secretary and then the Proscribed Organisations Appeal Commission, saying the case is not exceptional.
  • Mr Justice Chamberlain had allowed Huda Ammori’s challenge in July, finding it arguable that the proscription disproportionately interferes with free expression and assembly and that there was a lack of consultation.
  • A three-day substantive hearing had been listed for November in the High Court, which could be displaced if the appeal succeeds.
  • Palestine Action was proscribed in July after a June break-in at RAF Brize Norton that damaged two Voyager aircraft, with police estimating £7 million in damage and four members charged; Reuters reported more than 1,000 arrests since for public displays of support.
