High Court Reserves Verdict on Punjab’s Plea to Review Haryana Water Release Order

The Punjab and Haryana High Court has reserved its order on a plea seeking review of the Union home secretary’s directive to release additional water to Haryana.

On May 6, the high court directed the Punjab government to not interfere with the functioning of the BBMB and to abide by the Union home secretary’s May 2 decision, which asked BBMB to release an additional 4,500 cusecs of water to Haryana.

Overview

  • On May 26 the bench of Chief Justice Sheel Nagu and Justice Sumeet Goel paused its decision on Punjab’s request to modify the May 6 order.
  • The May 6 order instructed Punjab to implement the May 2 Union home secretary decision releasing 4,500 cusecs of water from Bhakra Dam to Haryana.
  • Additional Solicitor General Satya Pal Jain told the court that Punjab has neither complied with the order nor challenged it in the Supreme Court and accused the state of “bullying” institutions.
  • Haryana’s advocate general said the state sought the extra water as an emergency measure during an acute drinking water shortage rather than claiming Punjab’s share.
  • Punjab argues the May 2 meeting called by the home secretary was about law and order and that key facts were concealed from the court record.
