High Court Orders Three Ex-SABC Board Members to Repay R11.5 Million Over Motsoeneng 'Success Fee'

The SIU will enforce the default judgment with potential referrals to the NPA.

Overview

  • Judge Allyson Crutchfield of the Gauteng Division issued a default judgment making the trio jointly and severally liable for R11,508,549.12 plus interest from the date of service.
  • The order names Mbulaheni Obert Maguvhe, Ndivhoniswani Aaron Tshidzumba and Maleshane Audrey Raphela as responsible for repayment.
  • The ruling also requires the former board members to cover the SIU’s legal costs.
  • The payment was made in August 2016 as a 'success fee' for Hlaudi Motsoeneng’s role in a MultiChoice-related deal, a decision previously declared unlawful and invalid by the High Court.
  • The decision expands liability beyond Motsoeneng alone, enabling the SIU to recover funds for the SABC and, if warranted, to refer evidence of criminal conduct to prosecutors.
