Overview

  • On July 14, HHS finalized separations for thousands of employees whose layoffs had been stalled by lower court injunctions.
  • The cuts affect staff originally notified on April 1 across FDA, CDC and NIH divisions as part of a 10,000-job restructuring announced in March.
  • A Supreme Court stay on July 8 put a hold on a district court block and allowed the agency to proceed with part of its reduction-in-force plan.
  • A preliminary injunction in NY v. Kennedy shields employees in six CDC units, the FDA Center for Tobacco Products, the Office of Head Start and a planning division from immediate dismissal.
  • The Supreme Court stressed it “expresses no view” on the legality of any specific reorganization plan, preserving the potential for further legal challenges.
