Gujarat Promulgates Ordinance Extending Factory Shifts to 12 Hours and Permitting Women’s Night Duties

Overview

  • The ordinance revises Section 54 to raise the daily work limit from nine to twelve hours without altering the existing 48-hour weekly ceiling.
  • Workers must provide written consent for extended shifts and any overtime, which has a quarterly cap increased from 75 to 125 hours at twice the regular wage rate.
  • Women can now opt into night work between 7 p.m. and 6 a.m. under 16 specified safety and consent conditions.
  • Mandatory measures for night duties include proper lighting, CCTV surveillance, female security staff and secure transport for eligible employees.
  • The ordinance took effect on July 1 during the assembly recess and will be subject to formal ratification when lawmakers reconvene.
