The decision criticizes the in-class Gefährderansprache as disproportionate, paving the way for the family’s bid for formal rehabilitation through a pending suit against the education ministry.

Overview

  • On July 1, 2025, the Verwaltungsgericht Greifswald ruled that officers unlawfully removed 16-year-old Loretta B. from her classroom in February 2024.
  • The court held that pulling Loretta out in front of classmates was disproportionate and noted the meeting could have been held at home or a police station.
  • Police had confirmed from the start that none of Loretta’s eight TikTok posts, including an “HH” jacket logo mistaken for extremist symbolism, were criminal.
  • Loretta’s mother, Annett B., and family lawyer Ralf Stark argue the student suffered undue stigmatization and demand formal rehabilitation.
  • The ruling is not yet final, and the family has filed a separate lawsuit against the state education ministry to pursue full legal recognition of the intervention’s unlawfulness.
