Government to Table Bills Setting 30-Day Custody Rule for Removing PMs, CMs and Ministers

Overview

  • The Lok Sabha is slated to take up three measures on Wednesday: the Constitution (130th) Amendment Bill, the Government of Union Territories (Amendment) Bill, and the Jammu & Kashmir Reorganisation (Amendment) Bill.
  • Draft texts require removal from office if the Prime Minister, a Chief Minister or any minister is arrested and kept in custody for 30 consecutive days for an offence punishable by at least five years.
  • The mechanism directs removal by the 31st day on the relevant executive’s advice or automatic cessation thereafter, with a clause that a removed officeholder may be reappointed after release.
