Government to Seek Statutory Public Inquiry Into Children's Spinal Care After Harvey Morrison Case

Families will help set the terms through an independent facilitator to secure powers that compel evidence.

Overview

  • Tánaiste Simon Harris and Health Minister Jennifer Carroll MacNeill said they will bring a memo to Cabinet next week recommending a tribunal-style inquiry into scoliosis and spina bifida care.
  • The commitment followed a meeting with Harvey Morrison Sherratt’s parents and advocacy groups, where a facilitator was agreed to draft terms in collaboration with families.
  • A CHI whistleblower’s protected disclosure alleging Harvey was removed from a surgery waiting list in summer 2024 because he was deemed palliative is under investigation.
  • CHI and the HSE said the disclosure was routed from the Minister to the Protected Disclosures Commissioner and then to the HSE in September, with CHI receiving it this week after the HSE sought more information.
  • The Taoiseach said he “can’t comprehend” the alleged removal and Harvey’s mother urged that the inquiry cover systemic failures over decades and have the power to compel.
