Government Sets Capacity Rules for Minor Transfers, Warns of Enforcement

The move answers overcrowding in Canarias under court orders to safeguard unaccompanied children.

Overview

  • The Council of Ministers approved a decree defining each region’s ordinary capacity for receiving unaccompanied migrant minors based on population, unemployment, income and prior effort, with Catalonia and the Basque Country exempted for having met targets.
  • Ministers Ángel Víctor Torres and Félix Bolaños said refusals to accept assigned minors would be reported to prosecutors and could lead to police action to enforce compliance.
  • Regional governments led by the Partido Popular, including Madrid, Andalucía and Baleares, announced or filed appeals challenging the criteria, transparency and equity of the redistribution.
  • The state will increase transfers from 1 September and present a biweekly relocation calendar while keeping destinations confidential for child protection, and around 300 people, including unaccompanied asylum-seeking minors, have already left the Canary system.
  • Balearic president Marga Prohens requested contingency status to avoid receiving 49 minors from Canarias, though the Government’s delegate indicated the islands do not currently meet the threshold.
