Gómez Appeals Moncloa Email Seizure as Constitutional Court Freezes Amnesty Cases

Procedural maneuvers are pushing key rulings into October.

  • Begoña Gómez has asked the Madrid provincial court to overturn Judge Juan Carlos Peinado’s order to obtain all emails from her official Moncloa account since July 2018 for UCO analysis, arguing the measure lacks legal motivation and infringes communication secrecy and privacy.
  • Her defense has also appealed her summons as a suspect for malversación linked to the hiring and duties of her Moncloa aide, Cristina Álvarez, leaving the handover and forensic review of the emails contested and pending resolution.
  • Peinado’s request to the Presidency was issued after confirmation that Gómez holds a government account and at Vox’s urging, with the Guardia Civil’s UCO designated to examine the messages.
  • Carles Puigdemont has moved to recuse Constitutional Court judges Concepción Espejel, Enrique Arnaldo and José María Macías, leading the court to halt admission of his amparo appeal and to defer any decision on his bid to lift his national arrest order.
  • Toni Comín filed identical recusations, and the TC has also delayed the amparos of Comín and Lluís Puig; magistrate Laura Díez will report on the recusations, with court sources indicating the pause could last roughly a month.
