Germany Pushes for EU Approval of Tesla’s FSD Supervised

Berlin’s support combined with planned KBA vehicle tests may determine a December committee decision that will shape rules on safety and liability for driver‑assistance systems.

Overview

  • The Dutch type‑approval authority RDW granted a provisional Article 39(4) approval for Tesla’s FSD Supervised on April 10, 2026, allowing other member states to adopt that national approval.
  • Seven smaller EU countries have formally adopted the Dutch approval so far, covering about 12 percent of the EU population, while major states such as Germany, France, Italy and Spain have not taken that step.
  • The EU Technical Committee on Motor Vehicles did not vote at its October meeting and deferred a decision to December, meaning any EU‑wide approval still needs a qualified majority of member states and population share.
  • German Transport Minister Steffen Bilger said he will press for rapid EU acceptance and signalled Germany could act nationally if needed, while the KBA is reviewing RDW files and plans on‑road tests of a Tesla vehicle.
  • Key unresolved issues include whether the system can legally exceed speed limits by a small margin, how driver monitoring prevents misuse, how over‑the‑air activations are handled, and the lack of independent verification for Tesla’s claim that FSD reduces accidents by 4.1 times.
