Overview

  • The law extends detention up to 210 days to foreigners subject to a ban from French territory, those judged to pose a particularly grave threat to public order, and individuals convicted of serious crimes such as murder, rape or drug trafficking.
  • The National Assembly approved the proposal 303–168 with backing from the Socle commun, Rassemblement National and the centrist Liot group, while left-wing parties uniformly opposed it.
  • The text reinstates the conditional detention of certain asylum seekers and grants authorities the power to forcibly collect fingerprints and identity photos.
  • France Terre d’Asile and La Cimade warn that the vague “menace d’une particulière gravité pour l’ordre public” criterion risks arbitrary application and could deepen suffering and trauma in holding centers.
  • The legislative push followed the murder of student Philippine in 2024, whose alleged killer had been released from a Metz CRA despite an obligation to leave the country.
