Rubiales, along with three other men, Jorge Vilda, Rubén Rivera, and Albert Luque, are also accused of pressuring Hermoso to publicly state the kiss was consensual.
Rubiales' actions have sparked a national conversation in Spain about sexism in sports and the importance of consent.
Rubiales, who initially claimed he was the victim, resigned from his post in August 2023.
If found guilty, Rubiales could face a fine or a prison sentence of one to four years under a sexual consent law passed in Spain in 2022.
