- SB 1152, filed by Sen. Erin Grall, would bar drivers from holding or bracing a device, even when stopped at a red light or in traffic.
- GPS, calls and apps could be used only through hands-free systems, and the ban covers phones, tablets, laptops, two-way messaging and electronic gaming devices.
- Violations in school or work zones would carry escalating penalties: $150 and three points for a first offense, $250 for a second, and $500, four points and a 90-day suspension for a third.
- Exemptions include first responders, drivers reporting emergencies or suspicious activity, stationary vehicles, CB radios and certain in-vehicle systems.
- The proposal will be taken up when the 2026 session begins Jan. 13, currently lacks a House companion, and would take effect Oct. 1, 2026 if enacted.
