Florida Senator Files Hands-Free Driving Bill Ahead of 2026 Session

The measure faces its first tests when the session opens Jan. 13 after similar efforts stalled last year.

Overview

  • Sen. Erin Grall's SB 1152 would prohibit drivers from holding or bracing wireless devices, including when stopped at lights or in traffic.
  • The ban covers phones, tablets, laptops and gaming devices, while allowing calls and navigation only through hands-free systems like Bluetooth.
  • Violations in school or construction zones would bring tiered penalties, from a $150 fine and 3 points for a first offense to a $500 fine, 4 points and a 90-day suspension on a third offense.
  • The proposal bars officers from searching or confiscating a phone without a warrant and exempts first responders and drivers reporting emergencies or suspicious activity.
  • State data cite nearly 300 deaths and more than 2,200 serious injuries from distracted driving in 2024, and the bill would take effect Oct. 1, 2026 if passed, with no House companion filed yet.
