The Smart & Safe Florida committee has filed a new initiative to legalize recreational marijuana for adults 21 and older, targeting the 2026 ballot.
The revised proposal prohibits public smoking and vaping of marijuana and bans marketing appealing to children, addressing concerns raised by Gov. Ron DeSantis.
The measure includes a provision for potential home cultivation of marijuana and requires licensing of new recreational-only cannabis businesses, expanding beyond existing medical operators.
The 2024 initiative, which received nearly 57% voter support but failed to meet the 60% threshold, was heavily funded by Trulieve, Florida’s largest medical marijuana company.
Advocates must collect nearly 900,000 signatures and secure state Supreme Court approval to qualify the measure for the 2026 ballot.
