Federal Judge Rules Illegal Immigrants Are Not Protected by Second Amendment

Carlos Serrano-Restrepo, an illegal immigrant living in Ohio since 2008, was charged with unlawful firearm possession after an ATF investigation.
Federal agents seized approximately 170 firearms, tens of thousands of rounds of ammunition, and other items from his home earlier this year.
Serrano-Restrepo allegedly falsified U.S. citizenship on federal gun purchase forms to acquire at least 22 firearms for self-defense.
A federal judge denied his motion to dismiss the charges, ruling that the Second Amendment does not extend to individuals unlawfully in the U.S.
The judge cited historical precedent restricting firearm access for groups deemed outsiders or threats to national security; the trial is set for January 21, 2025.
