Overview

  • Judge Indira Talwani ordered the Trump administration to lift a months-long freeze on processing applications under Biden’s parole programs, saying the pause was not in the public interest.
  • The decision rescinds January and February pauses that halted status extensions for roughly 240,000 Ukrainians and 530,000 Cubans, Haitians, Nicaraguans and Venezuelans.
  • Talwani found the administration’s suspension of applications was arbitrary and capricious, in violation of federal administrative law.
  • The ruling also prohibits a halt on parole extension requests for relatives of U.S. service members and veterans during ongoing litigation.
  • The Justice Department has appealed to the Supreme Court, contending that the order encroaches on the executive branch’s authority over immigration policy.
