Federal Judge Halts Early Renewal of Enel’s São Paulo Power Contract

The ruling bars Aneel from proposing an early extension until the caducity review concludes.

Overview

  • Aneel must deliver within five days the full October 2024 administrative file that examines a possible recommendation to terminate the concession.
  • The court ordered Aneel to base any future assessment on detailed service-quality metrics, including TMAE, INS, IASC and DICRI.
  • São Paulo’s city government filed the suit citing repeated outages and slow restoration after storms and falling trees.
  • The current concession runs until 2028, and Aneel issued a preliminary technical note on September 25 indicating renewal requirements were met, subject to board review.
  • Aneel director-general Sandoval Feitosa acknowledged the interdependence of the renewal and failures inquiries, while Enel said it complies with its contract and trusts the renewal procedures.
