Overview

  • Judge Melissa DuBose granted a preliminary injunction on July 1 blocking HHS from finalizing layoffs or implementing further restructuring
  • A coalition of 19 states and the District of Columbia argued the cuts of 10,000 jobs and consolidation of 28 divisions into 15 exceeded executive authority
  • The injunction covers terminated employees at the CDC, FDA’s Center for Tobacco Products, the Office of Head Start and the Office of the Assistant Secretary for Planning and Evaluation
  • Since late March, HHS has rescinded hundreds of layoffs and Secretary Robert F. Kennedy Jr. acknowledged that up to 20% of terminations may be reversed
  • HHS must file a status report by July 11 as it evaluates appeal options and compliance with the court order
