Overview

  • On July 11–12, 2025, the Cámara Federal de San Martín upheld Juzgado Federal de Campana decisions for San Martín and Escobar, declaring Resolución Nº 267 unconstitutional.
  • Resolución Nº 267, issued in September 2024 by the Secretaría de Industria y Comercio under Luis Caputo, had barred municipalities from including non-contractual charges in their rates.
  • By nullifying the measure, the court restored municipalities’ capacity to fund essential services such as street lighting, waste collection and road maintenance.
  • Local leaders, including San Martín Mayor Ariel Sujarchuk, argued the resolution threatened constitutional autonomy and jeopardized investments in health, education and security.
  • The decision sets a binding precedent likely to influence similar legal challenges by other municipalities against federal fiscal constraints.
