Federal Control of D.C. Policing Persists as National Guard Patrols Continue

A court fight over using D.C. police for immigration enforcement now looms.

Overview

  • After D.C. sued, Judge Ana Reyes ordered the Justice Department to revise the takeover, stripping DEA chief Terrance Cole of the “emergency police commissioner” title and recasting him as a liaison while leaving federal oversight intact.
  • Federal agents and roughly 800 National Guard members remain deployed in the capital, with troops and Humvees visible near the National Mall after units reported to the D.C. Armory.
  • The White House says the operation will target homeless encampments by offering shelter and services and imposing fines or jail for those who refuse to leave.
  • Mayor Muriel Bowser and Attorney General Brian L. Schwalb argue the move violates the D.C. Home Rule Act and is unnecessary given falling crime, and their lawsuit is proceeding.
  • The court has not ruled on whether the administration can direct MPD to enforce immigration laws contrary to District policy, and a decision could come this week.
