Overview

  • On July 25, the Justice Department filed a federal criminal complaint charging Jose de Jesus Ortega and Danielle Nadine Davila with assault and conspiracy to obstruct ICE officers during a roving interior enforcement operation in Ontario.
  • Ortega was arrested July 25 and is expected to appear this afternoon before U.S. District Court in Riverside; Davila remains at large and is being sought by law enforcement.
  • The complaint states that the staffers, clad in medical scrubs, physically impeded agents pursuing a Honduran migrant who ran into the Ontario Advanced Surgical Center to evade arrest.
  • U.S. Attorney Bill Essayli said the migrant was not a patient and warned that anyone who interferes with federal officers will be charged with a federal crime.
  • If convicted, Ortega and Davila face statutory maximums of eight years in prison on the assault count and six years on the conspiracy count.
