Federal Cassation Court Rejects House Arrest for Julio De Vido

The panel found no concrete health risk that would require transferring him to home confinement.

Overview

  • Judges Guillermo Yacobucci and Javier Carbajo formed the majority to deny the request, with Mariano Borinsky dissenting in favor of granting house arrest.
  • De Vido will remain at the Ezeiza federal prison, where the court noted there is round-the-clock medical care and capacity to refer him to higher-complexity centers if needed.
  • Defense attorneys Maximiliano Rusconi and Gabriel Palmeiro cited his age of 76, diabetes, hypertension, and cardiac issues, and alleged inadequate insulin and diet in custody.
  • The court stressed that advanced age does not automatically entitle a prisoner to home confinement and that a specific, unmanageable health risk must be proven.
  • A prior order by execution judge Diego Basílico reported more than a month without episodes requiring hospital transfer, and De Vido has been detained since November 13 to serve a four-year fraud sentence in the Once case, which the Supreme Court affirmed.
