FdI Bill Filed to Fast-Track Evictions After Two Missed Payments

  • The proposal creates the Autorità per l’Esecuzione degli Sfratti under the Justice Ministry to issue an executive release order as an alternative to the civil procedure track.
  • After two consecutive unpaid rents, tenants get 15 days to cure; if not paid, the Aes reviews documents and can issue the release title within 7 days, with execution targeted in 30 days and extendable up to 90.
  • Tenants can appeal within 7 days, deferments are available for temporary hardship, and social services must be alerted within 5 days in cases involving minors, the non self-sufficient or people with disabilities.
  • Safeguards include fines of €5,000–€20,000 and temporary exclusion from housing benefits for abusive filings, a national emergency housing fund for ISEE under €12,000, and references to Spanish and Finnish fast-track precedents.
