Family Sues City and NYPD After Fatal Shooting of Queens Man in Mental Health Crisis

The suit alleges that officers violated NYPD guidelines by firing less than two minutes after arriving with a Taser followed by gunfire.

The New York Attorney General's office released police body camera footage of the March 27, 2024, police shooting of Win Rozario.

Overview

  • Rozario’s family filed the lawsuit Monday, naming the city, the NYPD and Officers Salvatore Alongi and Matthew Cianfrocco for violating his rights before he died.
  • Body-camera footage cited in the complaint shows officers deploying a Taser twice and then shooting Rozario four times in the chest within two minutes of entering his Ozone Park apartment.
  • The complaint alleges that officers disregarded mental health response policies, barred the family from their home for days and delayed medical aid to Rozario.
  • Critics say the city’s B-HEARD crisis response program operates limited hours in fewer than half of NYPD precincts, leaving most mental health calls to police.
  • No charges have been brought and the officers remain on duty in other assignments as the state attorney general’s office maintains its mandatory review.
