Family Launches Civil Claim After Rochdale Director Killed by Reversing HGV

It follows a £220,000 HSE fine for safety failures that left director Daniel Ames fatally trapped by a reversing HGV.

Overview

  • Daniel Ames’s family has filed a civil negligence compensation claim against British Millerain, represented by Express Solicitors to seek damages.
  • The British Millerain Company pleaded guilty to breaching section 33(1)(a) of the Health and Safety at Work etc Act 1974 and was fined £220,000 plus £5,634 in costs on July 10.
  • An HSE investigation found no risk assessment, no training for banksman duties and no safe system for reversing HGVs at the Buckley Road warehouse.
  • Following the prosecution the company carried out a risk assessment and introduced a safe system of work that prohibits banksman-assisted HGV reversals.
  • Express Solicitors partner Jon Andrews described the 2023 accident as “senseless and tragic” and said the family aims to secure their financial future through this legal action.
