EU Migration and Asylum Pact Enters Into Force

Its entry forces member states to start applying unified border and asylum rules with major human-rights and operational implications.

Overview

  • The pact came into force on 12 June 2026 and requires all 27 EU members to begin applying common rules on external borders, asylum procedures, reception and responsibility sharing.
  • The package tightens border controls and speeds up asylum decisions by introducing faster screening at frontiers, stricter deadlines for case review and wider biometric data sharing through an upgraded Eurodac system.
  • A separate EU Returns regulation that would expand detention periods and allow return centres outside the bloc remains unresolved and is the most contested element of the reform.
  • Spain has said it will apply the pact’s rules but will not use external return hubs and will stop issuing humanitarian residence permits for people who do not qualify for international protection.
  • More than 250 NGOs and child-protection groups warn the pact risks eroding rights and increasing detention of vulnerable people, many member states lack operational readiness, and EU technical meetings and likely legal challenges will shape how the rules are implemented.
