EU Agrees Major Overhaul of Air Passenger Rights

Proposals set to increase compensation wait times with capped accommodation obligations ahead of European Parliament review.

Overview

  • After 12 years of negotiations, EU member states have endorsed new proposals to revise air passenger rules under Regulation 261.
  • Compensation claim thresholds will rise to four hours for flights up to 3,500 km and to six hours for longer routes.
  • Future payouts will increase to €300 for flights up to 1,500 km, decrease to €300 for journeys between 1,500 and 3,500 km and fall to €500 for routes beyond 3,500 km.
  • Airlines’ duty of care will be confined to three nights of accommodation; carriers may claim costs incurred from third-party disruptions.
  • The proposals must still clear the European Parliament; consumer groups and some member states have voiced opposition.
