Overview
- The Election Commission issued a formal letter on Tuesday, November 3, 2026 telling state chief electoral officers that people whose names are missing from draft Special Intensive Revision rolls may submit Form 6 and that doing so will not, by itself, trigger action under Section 31 of the Representation of the People Act.
- The protection is conditional: applicants must not already be enrolled in another parliamentary or assembly constituency and their declaration must otherwise comply with the law.
- The ECI cited an October 14 Delhi High Court judgment that said petitioners’ fear that submitting Form 6 would amount to a false declaration was misplaced.
- Two Election Commissioners had objected to an extra SIR‑related declaration placed inside the online Form 6, and the ECI has separated that declaration from the statutory form while asking CEOs and EROs to widely publicise the Nov 3 guidance in local languages.
- The dispute remains unresolved: the Supreme Court will hear objections on November 19, 2026, key Delhi deadlines continue (claims/objections to Nov 25; final roll Dec 22), and campaigners warn millions removed from draft rolls face denial of services and ongoing political protests.
