ED Says FEO Case Against Mehul Choksi Can Proceed Despite Belgian Custody

Prosecutors told the Mumbai court his arrest abroad does not bar an FEO ruling that would enable asset seizure.

Overview

  • The Enforcement Directorate opposed Mehul Choksi’s plea to drop the Fugitive Economic Offender proceedings, saying he does not want to return and is contesting extradition in Belgium.
  • Choksi was arrested in Belgium in April on a Central Bureau of Investigation request and remains in prison there pending an extradition decision.
  • Additional Solicitor General Anil Singh argued the FEO law permits the case to continue until Choksi appears in India, adding the agency could reconsider if he surrenders.
  • Choksi’s lawyers argued his detention in Belgium amounts to “constructive custody,” claiming a fugitive designation is improper while extradition is underway.
  • The ED cited the Nirav Modi precedent and accused Choksi of filing numerous delaying applications, as the special court scheduled further hearing on the plea.
