Draft Bills Seek to Undo Colorado’s AI Consumer Protection Law

Four draft measures would narrow definitions, delay the start date or fold requirements into existing statutes before legislators convene

Overview

  • Multiple draft bills circulating ahead of a special session in late August propose to amend, narrow, delay or repeal SB 24-205, Colorado’s 2024 AI consumer protection statute.
  • One proposal would scrap SB 24-205 and instead require AI developers to comply with the Colorado Consumer Protection Act and Anti-Discrimination Act under attorney general enforcement.
  • Other measures would narrow “consequential decision” definitions, exempt small businesses and local governments and extend the law’s implementation date to 2027.
  • Gov. Jared Polis, Attorney General Phil Weiser and Senate Majority Leader Robert Rodriguez pledged to convene an AI Impact Task Force and address “unintended consequences,” but the January 2025 report offered no clear fixes.
