Overview

  • On August 5, the DOJ published a streamlined list identifying 13 states, 4 counties and 20 cities under Executive Order 14287 for limiting cooperation with ICE detainers.
  • The revised list follows the late-May withdrawal of an earlier version plagued by typographical errors and over-inclusion of pro-Trump jurisdictions.
  • Nevada officials, led by Governor Joe Lombardo, have rejected their state’s designation and announced plans to pursue legal and political challenges.
  • Some federal courts have already dismissed DOJ lawsuits against sanctuary policies, with an Illinois judge ruling they infringe on state sovereignty.
  • The DOJ has warned that it may update the list and suspend federal grants and contracts for jurisdictions that refuse to comply with immigration enforcement demands.
