DOJ and RealPage Propose Settlement Over Rent-Setting Software With Strict Data Limits

The agreement now enters a 60-day public comment period and judicial review under the Tunney Act.

Overview

  • The proposed consent judgment bars RealPage’s software from using competitors’ nonpublic data in runtime pricing and limits model training to information that is at least 12 months old.
  • RealPage must remove or redesign features that discouraged price cuts or aligned rival pricing and is prohibited from using geographic effects narrower than the state level.
  • The company must stop conducting market surveys to collect sensitive information, refrain from discussing nonpublic pricing trends in meetings, and accept a court-appointed monitor to oversee compliance.
  • The deal includes no admission of liability or monetary penalties, and RealPage says many product changes were already made or planned.
  • RealPage will cooperate in the DOJ’s ongoing case against landlord users, and the states’ related actions continue pending court approval of this federal settlement.
