DOE Cites Five Virginia School Districts for Title IX Violations and Opens Oregon Investigation

Districts have until August 4 to rescind gender identity–based access rules or risk enforcement actions including Justice Department referral.

Overview

  • OCR concluded that Alexandria City, Arlington, Fairfax County, Loudoun County and Prince William County Public Schools violated Title IX by allowing students to access female facilities and sports based on gender identity.
  • The department issued proposed resolution agreements requiring the districts to remove gender identity–based policies and adopt biology-based definitions in Title IX practices.
  • Those districts were warned that failure to sign the agreements could trigger enforcement actions up to referral to the Department of Justice and possible funding withdrawals.
  • In a separate move, OCR opened a Title IX investigation into the Oregon Department of Education after receiving a complaint from the America First Policy Institute alleging violations in transgender athlete policies.
  • These actions follow President Trump’s February executive order barring transgender girls from female sports and signify an intensified federal enforcement of Title IX.
