Diddy’s Lawyers Seek 14-Month, Time-Served Sentence Ahead of Oct. 3 Sentencing

Prosecutors are due to file their own recommendation next week seeking a substantially longer term.

Overview

  • Combs’ attorneys filed a sentencing memo asking Judge Arun Subramanian to impose no more than 14 months, which would amount to time served, followed by supervised release with mandatory treatment.
  • The defense cites nearly 13 months in Brooklyn’s Metropolitan Detention Center, describing suicide watch checks, limited clean water and inedible food, along with his sobriety and dozens of support letters as mitigation.
  • Sentencing is set for October 3, and prosecutors have until September 29 to submit their recommendation; they have signaled they will seek a substantial prison term, with guidelines estimated at up to about 5¼ years.
  • A Manhattan jury in July acquitted Combs of racketeering and sex-trafficking but convicted him on two Mann Act counts that carry a statutory maximum of 20 years; he remains detained after a $50 million bail bid was denied.
  • A separate hearing is scheduled for Thursday, September 25, on the defense motion to set aside the Mann Act convictions or grant a new trial, with appeals expected if the convictions stand.
