- DHS announced in a Sept. 5 Federal Register notice that the 2021 Temporary Protected Status designation for Venezuela will terminate at 11:59 p.m. local time on Nov. 7, 2025.
- The notice automatically extends certain Venezuela TPS Employment Authorization Documents only through Nov. 7, covering EADs with category codes A-12 or C-19 that originally expired on Sept. 9, 2022, Mar. 10, 2024, or Sept. 10, 2025.
- After Nov. 7, individuals granted TPS under the 2021 designation will no longer hold TPS or valid U.S. work authorization unless they secure another immigration status.
- On Sept. 5, a district court granted summary judgment for plaintiffs, finding DHS’s 2023 TPS revocation for Venezuela violated the Administrative Procedure Act, and DHS immediately moved for a stay pending appeal.
- The Ninth Circuit recently affirmed a March 2025 order pausing the 2023 revocation, but a Supreme Court stay keeps that order from taking effect, leaving the operational status of protections unresolved.
