Overview
- USCIS’s proposed rule, published September 24, 2025, is open for public comment through October 24, 2025.
- Registrations would be entered into the selection pool by wage level: Level IV four times, Level III three times, Level II twice, and Level I once.
- Employers would need to state the highest OEWS wage level met, the SOC code, and the area of intended employment on each registration.
- H-1B petitions would have to match the registration’s wage level, SOC code, and work location, and USCIS could deny or revoke if the selections were inappropriate or used to inflate selection odds.
- A September 19 Presidential Proclamation also directed DOL to initiate prevailing wage rulemaking, signaling a broader shift toward higher-paid roles that could, if finalized in time, affect the FY2027 cap cycle.
