DHS Ends Venezuelan TPS as Court Order Preserves Some Protections Through 2026

USCIS guidance limits continued status to re-registered Venezuelans with documents issued by February 5, 2025, expiring October 2, 2026.

Overview

  • The 2021 TPS designation for Venezuela formally terminates on November 7, 2025 at 11:59 p.m., following DHS’s September notice in the Federal Register.
  • A May 30, 2025 order from the U.S. District Court for the Northern District of California keeps certain TPS-related EADs, Forms I-797, and I-94 valid through October 2, 2026.
  • Eligibility for the preserved benefits requires re-registration under the 2023 extension and receipt of TPS documents dated October 2, 2026 that were issued on or before February 5, 2025.
  • USCIS is applying automatic extensions of up to 540 days for some TPS-related EAD renewals that were filed before February 6, 2025, allowing continued work authorization during processing.
  • The Supreme Court cleared the immediate end of the 2023 TPS designation on October 3, 2025, and those who do not meet the preserved-document criteria face loss of status and work authorization when their coverage expires.
