DHS Ends Automatic Work-Permit Extensions for Renewals Filed On or After Oct. 30

USCIS says the immediate change is meant to ensure renewed vetting before extending authorization, requiring many workers to have new EAD cards in hand to keep their jobs.

Overview

  • The interim final rule takes effect upon publication on Oct. 30, 2025, eliminating the up-to-540-day automatic extension for renewal applications filed that day or later.
  • Timely renewals filed before Oct. 30 remain covered by prior automatic-extension rules, with limited exceptions continuing for certain TPS-related extensions.
  • Receipt notices (Form I-797C) issued on or after the effective date will state they are not evidence of work authorization, and an unexpired EAD card will be required.
  • USCIS urges filing renewal applications up to 180 days early; if a renewal filed on or after Oct. 30 is still pending when the current EAD expires, employment must stop until a new card is approved.
  • DHS cites security and vetting concerns, referencing a June 2025 Boulder case, and is accepting public comments for 30 days while employers adjust Form I-9 reverification practices.
