DHS Ends Automatic EAD Extensions for Renewals Filed on or After Oct. 30

USCIS says the change prioritizes security by requiring completed screening before any work permit is renewed.

Overview

  • An interim final rule now in effect eliminates automatic Employment Authorization Document extensions for renewal applications filed on or after October 30, 2025, while applications filed earlier keep previously granted extensions.
  • Workers whose EADs expire before renewal approval must stop working, and employers can no longer accept I‑797C receipt notices as proof of extended authorization for post‑Oct. 30 filings.
  • USCIS is urging renewal filings up to 180 days before expiry to reduce the risk of work interruptions, with limited exceptions remaining for categories covered by statute or TPS Federal Register notices.
  • The change affects many EAD‑reliant groups, including asylum applicants, adjustment‑of‑status applicants, H‑4 dependent spouses, and certain students on OPT/STEM extensions, increasing the risk of employment gaps if processing lags.
  • USCIS cites fraud prevention and national security as the rationale, and it is taking public comments for 30 days even as the interim rule remains in force.
