Overview
- Transitional automatic extensions remain only for certain categories that filed renewals before October 30, 2025, with some extensions lasting up to 540 days.
- Renewals submitted on or after October 30, 2025 receive no automatic extension, and working on an expired EAD counts as unauthorized employment that can trigger job loss, denial of adjustment and other immigration penalties for workers and fines for employers.
- USCIS published the required I-765 evidence list, including an I-94 record, a copy of the prior EAD if any, two recent passport-style photos, a G-28 if represented, or a government ID for first-time applicants.
- Revised fees now apply: most I-765 filings cost $520 by paper or $470 online, some applicants with a pending I-485 pay $260, and certain asylum, parole or TPS categories are charged $550.
- Permanent residents and many holders of H‑1B, L‑1B, O or P visas do not need an EAD to work, whereas many asylum seekers, TPS holders and adjustment-of-status applicants rely on EADs and are directly affected.
