DHS Demands N.Y. Turn Over More Than 7,000 Incarcerated Noncitizens With ICE Detainers

New York officials say detainer decisions rest with local jails and police, not the attorney general.

Overview

  • Acting ICE Director Todd Lyons sent a formal letter to Attorney General Letitia James urging the transfer of more than 7,000 people in New York custody who have active ICE detainers.
  • DHS says New York jurisdictions released 6,947 individuals with active detainers since Jan. 20, citing aggregated charges that include homicides, assaults, sexual offenses, robberies, and weapons and drug crimes.
  • In a September reply cited in new coverage, James’ office said it rarely takes custody of individuals and noted that detainer requests go to various local agencies with differing lawful practices.
  • The DHS correspondence includes case examples of defendants released despite detainers who were later located by ICE, including Anderson Smith Satuye Martinez, Jose David Hernandez Hernandez, and Alexander Moreno Montoya.
  • ICE operations in New York City have continued, with recent protests in Lower Manhattan leading to multiple arrests as demonstrators attempted to obstruct enforcement activity.
