Delhi Sessions Court Issues Notice to Sonia Gandhi in Voter Roll Case, Sets Jan. 6 Hearing

The January 6 hearing will determine if the magistrate’s dismissal stands or if a police investigation is warranted.

Overview

  • Special Judge Vishal Gogne at Rouse Avenue Courts sought responses from Sonia Gandhi and the Delhi Police and called for the trial court record.
  • The revision petition by Vikas Tripathi challenges a September 11 order by ACJM Vaibhav Chaurasia that refused to direct an investigation under Section 175(4) of the Bharatiya Nagarik Suraksha Sanhita.
  • The complaint alleges Gandhi’s name appeared on the New Delhi voter roll in January 1980 before she became an Indian citizen, was deleted in 1982, and was entered again in 1983, with forged documents allegedly used to secure the entry.
  • The magistrate had found no prima facie grounds, cautioned against encroaching on the Election Commission’s domain, and noted the reliance on uncertified photocopies of roll extracts.
  • Counsel for the petitioner, Senior Advocate Pavan Narang, told the Sessions Court that attested electoral roll extracts have now been obtained and placed on record to support the claims.
