Delhi Puts New Traffic Challan Notification on Hold

The transport minister ordered a review of advocates’ representations so the Transport Department can brief the chief minister and lieutenant governor.

Overview

  • The Delhi government suspended the September 14 notification that would have rolled out a revised challan adjudication process while the Transport Department examines lawyers’ concerns.
  • Transport Minister Pankaj Kumar Singh said the department will review the representations from advocates and then report the findings to Chief Minister Rekha Gupta and Lieutenant Governor Taranjit Singh Sandhu.
  • Lawyers had objected to a rule requiring a 50% pre-deposit after an internal challenge is rejected and to the transfer of adjudicatory powers from judicial magistrates to SDMs and other executive or departmental officers.
  • The amended Rule 167 creates a 45-day pay-or-contest digital process that deems unchallenged challans accepted, a change advocates say will burden people who lack online access, including commercial and truck drivers.
  • The Coordination Committee called off a citywide strike and march after talks with the government on Wednesday, but some local associations including the Delhi Bar Association continued isolated strikes such as at the Tis Hazari court complex while the review proceeds.
