Delhi High Court Stops Law Colleges From Barring Exams Over Attendance, Orders BCI to Rework Rules

The order stems from a 2016 student suicide case, tasking the Bar Council to redesign attendance norms with credit for practical learning.

Overview

  • Until new rules are framed, no law student may be detained from examinations or held back from academic progression for attendance shortfall.
  • Colleges and universities are barred from imposing stricter attendance requirements than the Bar Council of India’s minimum norms.
  • The court directed immediate operational steps, including weekly online attendance updates, monthly notices to parents or guardians, and extra classes for students short on attendance.
  • The BCI must consult students, parents and faculty to revise norms in line with NEP 2020, giving credit for moot courts, debates, mock parliaments, internships and court visits.
  • Institutions must strengthen grievance redressal bodies, and the UGC was asked to consider regulations ensuring students make up 50% of committee membership as full members.
