Delhi High Court Rejects Wankhede Defamation Suit Over Aryan Khan Netflix Series as Not Maintainable

The judge dismissed the filing for lack of Delhi jurisdiction, leaving the defamation claims unresolved.

Overview

  • Justice Purushaindra Kumar Kaurav said the plaint could be considered in Delhi only if an amended filing shows publication or maximum reputational harm in the capital.
  • No fresh date was set for an amendment request, with the court stating the Registry will list any application when it is filed.
  • Sameer Wankhede sued Netflix, Red Chillies Entertainment and several platforms seeking an injunction and Rs 2 crore in damages to be donated to Tata Memorial Cancer Hospital.
  • The suit alleges a defamatory portrayal and cites a scene invoking the national motto followed by an obscene gesture, asserting a violation of the Prevention of Insults to National Honour Act, 1971.
  • Wankhede, who led the 2021 NCB raid in which Aryan Khan was arrested before later receiving a clean chit, declined detailed comment and said, “Satyameva jayate.”
