Delhi High Court Rejects Sameer Wankhede’s Defamation Suit for Lack of Delhi Jurisdiction

The judge said the complaint failed to show a Delhi cause of action under civil procedure rules, leaving scope for a revised plaint to be listed later.

Overview

  • Justice Purushaindra Kumar Kaurav held the plaint not maintainable in Delhi and said he was rejecting the complaint, pointing to deficiencies in establishing jurisdiction under the Code of Civil Procedure.
  • Sameer Wankhede sought a permanent and mandatory injunction, a declaration, and ₹2 crore in damages to be donated to Tata Memorial Cancer Hospital.
  • The suit names Red Chillies Entertainment, Netflix, X Corp, Google LLC, Meta Platforms Inc, RPG Lifestyle Media Pvt Ltd, and unidentified parties.
  • Wankhede alleges the Netflix/Red Chillies series is false and defamatory and cites a scene invoking “Satyamev Jayate” followed by an obscene gesture, which he says also offends the Prevention of Insults to National Honour Act.
  • No new hearing date was set, the registry may list any amended filing, and Wankhede declined detailed comment, saying only “satyameva jayate” as reporters noted his role in Aryan Khan’s 2021 case that later ended in a clean chit.
